Terms of Service

These terms govern your use of Drova. By creating an account you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.

What Drova does

Drova is a dispatch and tracking tool. It lets a transport operator dispatch drivers, send customers a live tracking link, record job history and distance, and draft invoices from that record. Drova does not carry freight, employ drivers, or act as a party to any transport contract between you and your customers.

Your account

You are responsible for keeping your company code and passcode secure, and for everything done under your account. Tell us promptly at support@drova.au if you believe your account has been accessed by someone else.

You must give accurate information when signing up and keep it current.

Free trial and subscription

Your trial runs for 7 days from signup. We collect your card details when you start it, but you are not charged during the trial.

At the end of the 7 days your subscription begins automatically and your card is charged, at the plan and price shown to you at signup. To avoid being charged you must cancel before the trial ends. You can cancel at any time from your billing settings, in one click, with no phone call required.

Subscriptions renew automatically each month or each year, depending on the plan you chose, until cancelled. Prices are in Australian dollars and include GST where applicable.

If your per-vehicle count changes, your charge changes accordingly from the next billing period.

Cancelling and refunds

You can cancel at any time. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. We do not provide pro-rata refunds for a partly used period.

Nothing in these terms excludes your rights under the Australian Consumer Law. If the service is faulty in a way that amounts to a major failure, you are entitled to a remedy under that law regardless of anything written here.

If payment fails

If we cannot charge your card, your account moves to read-only. You keep access to your history and invoices, and any job already in progress continues to track and can be completed normally — we will not cut off a job that is on the road. You will not be able to create new jobs until payment succeeds.

Tracking drivers — your obligations

Drova records a driver's location while they are on a job. If your drivers are employees, you may have legal obligations to notify them before tracking them. In New South Wales the Workplace Surveillance Act 2005 requires at least 14 days' written notice before an employer carries out tracking surveillance, and other states have their own rules.

Meeting those obligations is your responsibility, not ours. By using Drova you confirm you have the right to collect location data from the drivers you dispatch, and that you have given any notice or obtained any consent the law requires.

Information about other people

When you enter a customer's name and mobile number, or a driver's details, you are asking us to handle information about someone else. You confirm you are entitled to provide it and to have us contact those people by SMS on your behalf. You must not use Drova to send marketing messages or anything unrelated to a job.

Accuracy of tracking, distance and invoices

GPS is imperfect. Signal drops, devices are switched off, and estimated arrival times are estimates. Distance figures are recorded from the driver's device and any odometer reading the driver enters, and may not exactly match your own records.

Invoices drafted by Drova are drafts. They are prepared from the job record for your convenience. You are responsible for checking every invoice before you send it, and for your own tax and record-keeping obligations. We are not your accountant or tax adviser.

Availability

We aim to keep Drova running continuously but do not guarantee uninterrupted availability. We may need to take the service down for maintenance, and we may change or discontinue features. If we make a change that materially reduces what you are paying for, you may cancel and we will refund the unused portion of that period.

Acceptable use

We may suspend an account that breaches these terms, and will tell you why.

Your data

Your job records are yours. You can export or request a copy at any time. If you close your account we delete your data within 90 days, except where the law requires us to keep it. How we handle personal information is set out in our Privacy Policy.

Liability

To the extent permitted by law, and except for rights under the Australian Consumer Law which cannot be excluded, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential loss, including lost profits or lost business, arising from your use of Drova.

You remain responsible for your transport operations, your compliance obligations, and your contracts with your own customers.

Changes to these terms

We may update these terms. If a change materially affects you we will give you reasonable notice by email before it takes effect. Continuing to use Drova after that means you accept the change.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state.
